PRESIDENT OF THE REPUBLIC PROMULGATES THE DECREE NO. 3 / V OF THE NATIONAL PARLIAMENT

On December 13, 2018, His Excellency the President of the Republic exercised the political veto over National Parliament Decree No. 3 / V, which approved the first amendment to Law 13/2005 of September 2, Law on Petroleum Activities, in accordance with the powers vested on him by the Constitution, pursuant to Article 85 (a) and Article 88 (1) of the Constitution of the Republic.
The political veto to Decree No. 3 / V of the National Parliament was accompanied by a Message on December 13, 2018, by which His Excellency the President of the Republic requested the National Parliament to reconsider that Diploma on the grounds provided for under such a message, as set for in Article 88 (1). The National Parliament, by 41 votes in favor and 1 against, confirmed the approval of Decree No. 3 / V of the National Parliament for the purpose of its conversion into law, and followed for such an approval the rule of absolute majority on the total of deputies seating at the National Parliament, under article 88 (2) of the Constitution of the Republic. The notice of such a confirmation was given to His Excellency the President of the Republic through an official letter from the President of the National Parliament of January 10, 2019, which entry registered in the Presidency of the Republic was on the following day.
The President of the Republic examined the said Decree, confirmed by the National Parliament, noting that there was no change on its wording, as previously submitted for promulgation.
In this context, the President of the Republic must promulgate the Decree No. 3 / V “within eight days of receiving it”, according with what is written in the final part of paragraph 2 of article 88th of the Constitution .
Therefore, on the same date of this Press Statement, His Excellency the President of the Republic has promulgated the “Decree of the National Parliament No. 3 / V – which approved the first amendment to Law 13/2005, of September 2, Law , on Petroleum Activities ”, thus converting it into Law, secondly as determined in the final part of n°. 2 of article 88 of the Constitution.
Following the confirmation of the Decree No. 3 / V by the National Parliament, which was preceded by a political veto by the President of the Republic, the President of the Republic has the constitutional duty to sole promulgate it. This promulgation does not mean a political or legal judgment favorable to said Decree and, even less, that it can be interpreted as an inhibitor of any claim for abstract review of its constitutionality and legality, under the terms provided for by Article 150 of the Constitution of the Republic.
